PlayStation Hack – Sony Seeks Coverage Under Its CGL Policies

Sony insurers are engaged in litigation in New York state court to determine Sony entities’ claims for insurance coverage with respect to lawsuits, claims and potential attorney general actions arising out of the cyber-attacks earlier this year on the PlayStation Network (“PSN”), Sony Online Entertainment Network (“SOE”) and Sony Pictures Network, which allegedly resulted in unauthorized access to and alleged theft of personal identification and financial information of millions of customers.

President Obama Proposes Cybersecurity Legislation

The White House has issued a cybersecurity legislative proposal (the “Proposal”) aimed at improving cybersecurity for American consumers, the U.S. critical infrastructure, and the Federal Government’s own networks and computers.  In issuing the Proposal, the White House stated that the U.S. critical infrastructure, such as the electricity grid, financial sector, and transportation networks, have suffered repeated cyber intrusions, and that cyber crime is on the rise.

Client Advisory – California Supreme Court’s Zip Code Decision Exposes Retailers to New Litigation Hazard, Statutory Fines

A recent decision of the California Supreme Court is sending a chill through a common retail practice: requesting a customer’s ZIP code during a credit card transaction for research and marketing purposes. The decision, in Pineda v. Williams-Sonoma Stores, Inc., found that the practice of collecting ZIP codes violates a California statute, the Song-Beverly Credit Card Act, which forbids businesses from requesting “personal identification information” during a credit card transaction.

The Federal Trade Commission (the “FTC”) recently issued a publication entitled Businesses Must Provide Victims and Law Enforcement with Transaction Records Relating to Identity Theft (the “Publication”).  As outlined in the Publication, the Fair Credit Reporting Act provides victims of identity theft with the right to ask businesses for a copy of transaction records relating to the theft of their identity (“Transaction Records”).
