On August 1, 2026, the Pennsylvania Insurance Department (the Department) published an updated export list in the Pennsylvania Bulletin (the Export List). Under section 1604(2)(ii) of The Insurance Company Law of 1921 (40 P.S. § 991.1604(2)(ii)), the Insurance Commissioner declares the coverages on the Export List to be “generally unavailable in the authorized market at the present, and thus exportable.” Accordingly, for those coverages included on the Export List, a diligent search among insurers admitted to do business in the Commonwealth is not required before placement of the coverages in the surplus lines market. The Export List supersedes the list published at 55 Pa.B. 2697 (April 5, 2025). Among the coverages on the Export List are active assailant coverage; commercial cyber insurance (inclusive of first-party and/or third-party commercial cyber insurance coverage); medical malpractice liability, with or without related general liability coverages; products liability and products recall (monoline) for the manufacturing of various products, including aircraft and component parts, automotive and component parts, firearms, medical equipment, petrochemicals, and pharmaceuticals; coverages for artificial intelligence developers and users of generative AI (third-party liability and first-party coverage); medicinal cannabis operations; pollution liability and/or environmental impairment coverage; and title insurance agents errors and omissions, among others. The Export List became effective on the date of its publication in the Pennsylvania Bulletin and will remain in effect until superseded by a subsequent list.
