Property and Casualty Insurance

Connecticut:  On August 12, the Connecticut Workers’ Compensation Commission (“WCC”) issued Memorandum 2020-14, regarding reporting requirements pursuant to Governor Lamont’s Executive Order (the “Order”) 7JJJ. The WCC is requesting that insurers provide claims information, pursuant to the Order in advance of the September 1, 2020, deadline.  The Order required the WCC, beginning August 1, to produce a report each month on COVID-19 workers’ compensation claims to the Office of the Governor and the joint standing committees of the General Assembly.

New York:  On August 18, the New York Workers’ Compensation Bureau issued Subject No. 046-1323, Emergency Adoption of the addition of 12 NYCRR 329-1.3(d) to allow reimbursement for COVID-19 testing when there is a claim for workers’ compensation benefits due to workplace exposure to COVID-19. The emergency rulemaking is effective for 90 days upon filing August 17, 2020.
