Locke Lord LLP Atlanta Partner Brian Casey and Austin Senior Counsel Jon Gillum have co-authored an article for Law360 explaining how to navigate federal and state laws for service contracts, which are also known as extended warranties.  Their article analyzes when and how such contracts are subject to the federal Magnuson-Moss Warranty Act (MMWA) in addition to state-based regulation.  Due to regulatory complexity, “the application of the MMWA to service contracts can be both nuanced and confusing. This article is intended to help navigate the subtle boundaries between the MMWA and state service contract laws and understand the difference between service contracts and insurance products.”
