In our September 2010 issue of Insurance and Reinsurance Review, we reported on the Law Commission’s proposed amendments to the duty of good faith as set out in Issues Papers 6 and 7.

The Law Commission has since published a summary of responses to both papers and also two further Issues Papers: Issues Paper 8, The Broker’s Liability for Premiums: Should Section 53 be Reformed?; and Issues Paper 9, The Requirement for a Formal Marine Policy: Should Section 22 be Repealed? We will touch briefly on the key findings in each of these papers below and outline what we can expect in the year or so ahead.
