During the National Association of Insurance Commissioners’ (NAIC) winter meeting, the Restructuring Mechanisms for Troubled Companies (E) Subgroup adopted the “White Paper on Alternative Mechanisms for Troubled Companies” (the “White Paper”).  The White Paper reviews various approaches for insurers and regulators to handle impairment and insolvency issues, and discusses each approaches advantages and disadvantages.  The research was “prompted by the growing number of troubled insurers seeking to engage in run-off or restructuring as opposed to being placed in traditional receivership proceedings.”  The White Paper will next be considered by the NAIC Financial Condition (E) Committee.
