Four insurers, Aviva, AXA Insurance, RSA and Zurich, yesterday initiated judicial review proceedings regarding The Damages (Asbestos-related conditions) (Scotland) Act. As we reported previously, the Act reverses in Scotland the 2007 decision of the House of Lords in Rothwell, which ended compensation for pleural plaques. In a statement the ABI said that insurers are against the Act because it ignores the fact that pleural plaques are symptomless and fails to take into account the financial impact on Scottish firms and taxpayers.
